Terms of service

You sign up with an email address and a password, and your team sends with API keys you create. Whoever holds one of those keys is treated as you, so a key is as sensitive as the password behind the account that made it.

1. Who these terms are with

They are with you: the person or organisation that pays for a plan, and anyone acting for you. If an agent, script or employee sends on your behalf, you are bound by what it does. We have no way to tell an agent from the person who deployed it, and we do not try.

2. What the service is

A transactional email API, an SMTP relay, delivery event webhooks, message logs, and the dashboard that reads them. It is for mail a recipient asked you for. What may and may not be sent is set out in the acceptable use policy, which forms part of these terms.

We add and remove capability as the product develops. A plan you have already paid for keeps the volume and window it was sold with.

3. Your account and your keys

An account is created when you sign up with an email address and a password, or with a Google or GitHub sign-in, and confirm the address. API keys are created inside it and are how everything else authenticates.

  • Anyone presenting your API key has full control of your account, including the ability to send mail that is attributed to you. Treat it as the credential it is.
  • A key is shown once and cannot be shown again. We store only its hash, so a lost key is replaced rather than recovered: sign in and create another. Keep a second live key so that revoking a leaked one is never your last move.
  • You are responsible for everything done with your key, including by an agent you deployed and including after it leaks.

4. Payment

Paid plans are bought by card through Stripe, our payment processor, at the price shown on the pricing section when you check out. Stripe holds the card details; we do not.

  • A paid plan is a fixed number of sends over a fixed 30-day window, and it renews every 30 days until you cancel it. When the volume runs out, sending stops until the window renews or you move to a larger plan.
  • The free tier costs nothing and is where a team with no paid plan sits: 3,000 sends per calendar month, resetting on the first, UTC. It carries the same rules as a paid plan, at a smaller volume.
  • The refunds page explains when we will consider sending money back, and what happens if you dispute a charge with your bank.
  • Prices exclude any tax that may apply where you are. Where we are required to charge or account for tax, we will say so before you pay.

5. Sending, identities and limits

You send from a domain you own and have verified with us, on every plan. Complaint-rate and bounce-rate thresholds and daily caps are enforced automatically, and are described in the acceptable use policy.

You keep every right in the content you send. You give us permission to transmit, store and log it for as long as the plan’s retention window states, which is what makes the log and the replay in the dashboard possible.

6. Suspension and termination

We may suspend a sending domain, revoke a key, refuse further payment, or end an account where the acceptable use policy is breached, where a sender is damaging delivery for others, or where the law requires it. Where mail is going out and doing damage, we act first and explain afterwards.

You end the relationship by cancelling the plan in the billing portal, or by leaving the free tier unused. What happens to a part-used window is on the refunds page.

7. Availability and warranties

The service is provided as it is. We do not warrant uninterrupted or error-free operation, and we do not guarantee that any particular message is delivered or reaches an inbox rather than a spam folder — the receiving mailbox provider decides that, not us.

Where a plan you bought states a specific service commitment, that commitment applies to that plan. Nothing else on the website is a promise of a service level.

8. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, for lost profits, or for loss arising from mail that was not delivered or was delivered late. Our total liability for any claim is limited to the amount you paid us for plans in the thirty days before the claim arose.

Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

9. What you are responsible for

You are responsible for the mail you send, for having the recipient’s consent to send it, and for complying with the law that applies to it where you are and where the recipient is. If a claim is brought against us because of mail sent with your key, you will cover what it costs us.

10. Changes to these terms

We may change these terms. The current version is the one published here, and it applies from the date at the top of this page. A plan you bought before a change keeps the volume and window it was sold with; continuing to use the service, or buying again, accepts the version in force at that moment.

11. Law and disputes

These terms are governed by the law of [GOVERNING LAW JURISDICTION], and the courts of [COURTS JURISDICTION] have exclusive jurisdiction over any dispute arising from them. If mandatory consumer law where you live gives you rights these terms do not offer, those rights apply.
